@emmajaneg I thoroughly recommend that you contact @TC1474 in regards to the incident and get some decent advice from someone who is in the know


I wouldn't waste your time with your own insurance company's solicitors as they are just after a quick settlement and you could end up losing out

 

YES YES YES........ :stupid: :stupid: :stupid: ..........Please get in touch with an independent Motorcycling specialist solicitor as soon as possible. DO NOT RELY ON YOUR INSURANCE COMPANY. They are only out to make it easier for themselves, NOT YOU. I believe Dalton White's have a good reputation but please, please have a look round. Vital to collate witness statements at this time, and get your b/f to make a note of what he saw while it is still fresh in his mind. Make sure you include the bits about no trailer lighting or signals. The bloke who was waving at you should have been there to tell his mate it was safe to manoeuvre NOT to warn you that an illegal trailer was moving about in the road.


Just tell your insurers that you are seeking independent legal advice, and do it as soon as possible. DON'T FORGET THEY ARE NOT INTERESTED IN YOU - ONLY THEIR PROFIT MARGIN. People will try to b/s you, as you have already found, and you need an independent source of advice.

No point talking to me. It has been made quite clear that I know nothing. I am unable to assist.


I would suggest that you speak to the forums resident legal and riding experts of which there are a few on this forum.


I only posted a comment because of the crap which was being spouted and which would give the experts on here a chance to make their comments.


There are several people on this site who will be able to provide the benefit of their legal and riding expertise who are far more knowledgable and qualified than me.

I have no idea of the intricacies of British law but as someone who regularly tows trailers of various kinds I would make the following observations....


Many trailers don't have reverse lights.


Reversing any kind of trailer on the road with traffic in sight is a complete no go, you just don't do it no matter how good you at reversing.


The smaller the trailer the harder it is to reverse as it will swing faster and often be unseen from the towing vehicle.


Having a trailer on the road without the electrical connection being attached is stupid and amounts to carelessness.


If you ran into a trailer that was being reversed on the road then the advice to obtain independent advice is sound, but that needs to be professional advice sought face to face with all the facts clearly set down. Internet legal keyboard warriors are not necessarily your best option.

These guys (although please bear in mind I have no experience of them) might be worth a phone call, that won’t cost you anything. It will be the same with Dalton Whites, you could give them a ring see what they have to say.


On insurance claims the cost of any help is usually claimed back in insurance. If additional cost concerns you just get them to clarify how it works before they start work on your behalf- and it really does help to have someone fighting for you who knows how the slipperiness works!

Yo, Rich - Emma might not wanna hear about your off......but we do, for sure!


I will keep the inevitable discussion - re. the fact that we're like a row of old vultures, sitting on a fence all the while taking inordinate pleasure from the misfortune of others (Hmmm. ..there ought to be a word tor that.....:roll: ) arm's length and instead concentrate on the many learning points that your tale will inevitably gift to us all.


In the interests of clearing the decks so Emma can begin to marshal the resources necessary to fight and win her case, perhaps you could start another thread? I'm serious - this is one of the best ways of learning. I've had me fair share of incidents and events, and if anybody can use them to avoid making the same mistakes again, so much the better. The minute you stop learning you're probably in the ground.


And Emma, I know you're probably really pissed off at all this, BUT MAKE THOSE CALLS. It won't cost you owt but could make a big difference to the outcome of your travails.

Regarding insurance/solicitors, it's a minefield I'm afraid.

I had a nasty head on with a merc. I came off relatively well considering, my right shoulder suffered a subluxation, a couple of cracked ribs, some impact/crush damage down my right side. Worst was my foot, where I broke a metatarsal, and my big toe was crushed in a way it split the skin down the side right through to the bone (which felt lovely when the cold air hit it when they took the boot off). Sounds nasty but I was only in a cast for a few months, walking with a bad limp for several months after. Because I was young, I more or less completely healed.


Don't go with the insurance recommended solicitors. Find a well reviewed no win no fee outfit.


I did and it made a big difference, my insurance company wanted to go for a quick settlement. The independent really fought hard for me, and I walked away happy. If you need help, just PM me on here, as there are a few points where wording is crucial, because their insurance will pull you up on *anything*.


And don't let ideas of grandeur enter your mind regarding the settlement, it's to cover what has happened to you. I used mine as a house deposit.

I’d love to hear your story! Quite funny actually because I biker that had stopped to help me actually said “You Betta get back on a bike and have a story to tell young lady!” And I promised him I would. I struggle with anxiety so it’s best I don’t dwell on these things

Thank you! You’re all absolutely fantastic people and so kind. This is all new to me (I’m still a baby according to most bikers) and so far I have just called insurance. I have been assured that it definitely didn’t sound like I was liable so, so far, so good!

I'm just hijacking this thread for a minute to ask a question my son asked me the other day: What do motorcycle cops do in winter when it's too snowy to ride?


They drive the chase cars . As you don't see many motor bike cops after 6pm as its classes as to dangerous to ride at night . All most all cop bikers are car drivers.

 

Could you imagine them on like, snow skis? That’s maybe better than motorbikes. I mean I slid off mine in ice so god knows what they’d do 😂😂

I feel like this thread has turned into some advertisement scheme so I am going to stop replying to those who are just saying to contact people. My insurance company is a very small company themselves and so far, they have been great with me and already mentioned a replacement motorbike. Thank you for the concerns though.

At the risk of being repetitive......DO NOT ACCEPT THE "REPLACEMENT MOTORBIKE" BEFORE YOU HAVE FOUND OUT WHAT IT WILL COST YOU.

There - did I say that loud enough? The supply of "replacement bikes" is used by some insurers as a massive con to screw money out of you. BEFORE you sign anything, make sure that you ask HOW MUCH IT WILL COST. As I've already said, these people aren't charities. Yes, I know, it's up to you what you do, but just be careful. Profit from the experience of others - or not, it's your choice. Hope the knee's feeling a bit better today.

They just have some experience of how insurance companies behave and are concerned you don’t end up on the wrong side of things- like they have in the past. There’s not a vested interest although I can see it might look that way to you.


Assuming your insurance company is on your side is a lovely outlook to have, one I also used to share until experience changed my mind and that is what motivates all the comments for you to get help. Buuuutttt (not your sore one lol) if it’s not what your wanting to hear and you just need some light relief then so be it :thumb:

Maybe just have it in the back of your mind somewhere.....
